§ 1 Scope, conclusion of the contract
1.1 These General Terms and Conditions, including the house rules attached as Annex 1, apply to contracts for the provision of apartments for temporary accommodation in return for payment and to all related further services of MaMori Betriebs GmbH, MLoft Apartments Munich (hereinafter “MLoft”).
1.2 The contract is concluded when MLoft confirms the guest’s booking in text form (e.g. by email) or, if confirmation was no longer possible, makes the apartment available. For bookings via booking portals, the conditions stated there additionally apply to the booking process.
1.3 Deviating terms and conditions of the guest do not apply, even if MLoft does not expressly object to them.
1.4 The language of the contract is German.
1.5 The house rules of MLoft Apartments Munich (Annex 1) form part of these Terms and Conditions and therefore part of the contract. The guest is expressly referred to the house rules before making a booking. They can be viewed on the website. In the event of any contradiction between the house rules and the other provisions of these Terms and Conditions, the other provisions take precedence.
§ 2 Services, prices, occupancy
2.1 The scope of the contractual services is determined by the description of the apartments on www.mloft-apartments-muenchen.de and the details in the reservation confirmation. In the absence of a specific price agreement, the prices published on the website at the time of booking apply.
2.2 Prices are per apartment and night and include statutory VAT, weekly cleaning of the apartment, a weekly change of linen (towels and bed linen) and the costs of electricity, water and heating.
2.3 Additional services are not included in the apartment price and are charged separately, in particular: underground parking space (€15 per night), shopping service (price depending on scope).
2.4 If more than four months elapse between the conclusion of the contract and the agreed start of the services and the statutory VAT rate changes during this period, the agreed price changes accordingly.
2.5 The apartment may be occupied by no more than the number of people confirmed in the booking. A higher occupancy is only permitted with MLoft’s prior consent and, where applicable, for a surcharge.
§ 3 Payment, deposit
3.1 The apartment price is due before or on arrival, at the latest before moving into the apartment, unless an earlier due date has been agreed for the booked rate (in particular for non-refundable rates under section 5.2). For longer stays with monthly invoicing, the price is due on the 1st of each month for the current month.
3.2 Payment is made by credit or debit card (girocard). Cash payment at the check-in terminal is not possible. Special conditions are possible for corporate customers by prior arrangement, in particular payment by bank transfer before arrival. Deposits under section 3.3 can be paid by bank transfer.
3.3 For a booking value of €2,500 or more, MLoft may request a deposit of 20 % of the booking value. The deposit is due within 3 days of receipt of the booking confirmation. If the deposit is not paid despite a reminder and a reasonable grace period, MLoft is entitled to withdraw from the contract.
3.4 If the guest is in default of payment, MLoft is entitled to refuse further services under the current contract and, in accordance with the statutory provisions, to claim damages or to withdraw from contracts for future services.
3.5 The guest may only set off claims that are undisputed or have been finally established by a court.
§ 4 Arrival and departure
4.1 The apartment is available from 3 pm on the day of arrival. Check-in is contactless at the check-in terminal on the 1st floor. The name or booking code, a valid identity document and a credit or debit card are required.
4.2 The apartment is held until 11 am on the following day unless the guest has notified a later arrival. After that, the booking is deemed a non-arrival within the meaning of section 5.
4.3 The apartment must be vacated by 11 am on the day of departure. If the apartment is vacated later, MLoft may charge 50 % of the list price for one night for the additional use until 3 pm and 100 % from 3 pm. This does not give rise to any contractual claims of the guest. The guest is entitled to prove that MLoft has suffered no loss or a significantly lower loss.
§ 5 Cancellation, non-arrival
5.1 The cancellation terms of the booked rate apply to cancellations and non-arrival. They are shown to the guest before the booking is completed and are stated in the booking confirmation. The cancellation terms may differ depending on the rate, season, length of stay and number of apartments booked.
5.2 MLoft may offer specially marked rates at a reduced price compared with the flexible rate, in return for which the guest waives the option of cancellation (non-refundable rate, “Non-Refundable”). For these rates, the full price is due on booking; there is no refund in the event of cancellation, non-arrival or early departure. This is a separate pricing model with a reduced price, not a lump-sum compensation; sections 5.5 and 5.6 do not apply to these rates.
5.3 If, exceptionally, no cancellation terms under section 5.1 have been agreed for a booking, the following applies: cancellation free of charge up to 7 days before arrival; after that and in the event of non-arrival, 90 % of the total accommodation price. Non-arrival (no-show) is treated as a cancellation on the day of arrival.
5.4 The total accommodation price is the confirmed overnight price for the entire period for which MLoft kept the apartment available for the guest, excluding separately agreed additional services.
5.5 If MLoft succeeds in letting the apartment to others for all or part of the cancelled period, the proceeds obtained are credited against the compensation. This also applies to cancellation terms under section 5.1.
5.6 The guest is entitled to prove that MLoft has suffered no loss or a significantly lower loss; this also applies to cancellation terms under section 5.1. MLoft is entitled to prove a higher loss; in this case, the loss must be specifically quantified and substantiated.
5.7 Cancellation should be declared in text form (e.g. by email). Receipt by MLoft is decisive.
§ 6 Early departure, termination of long stays
6.1 The guest may terminate stays of 31 nights or more early by giving 14 days’ notice. Notice should be given in text form (e.g. by email); receipt by MLoft is decisive. If the guest leaves early without observing this notice period, the guest owes the agreed price until the end of the notice period. Expenses saved and proceeds from re-letting the apartment are credited; section 5.6 applies accordingly.
6.2 For stays of up to 30 nights, there is no right to leave early free of charge. If the guest leaves early, the agreed price remains payable for the entire booked period. Expenses saved and proceeds from re-letting the apartment are credited; section 5.6 applies accordingly.
6.3 For non-refundable rates under section 5.2, there is no refund in the event of early departure; sections 6.1 and 6.2 do not apply to these rates.
§ 7 Termination and withdrawal by MLoft
7.1 MLoft may terminate the contract without notice for good cause, in particular if the guest uses the apartment in breach of the contract, breaches the rules on use and on making the apartment available to others under sections 9.1 and 9.2, exceeds the permitted number of people, persistently disturbs the peace of the house, breaches the smoking ban or the fire safety rules under section 8 despite a warning (in the case of serious breaches also without a warning), breaches the rules on bringing dogs under section 9.8 or is in default with payments due despite a grace period.
7.2 If MLoft terminates the contract for a reason for which the guest is responsible, MLoft retains its claim to the agreed remuneration. Expenses saved and proceeds from re-letting the apartment are credited; the guest is entitled to prove that MLoft has suffered no loss or a significantly lower loss.
§ 8 Fire safety, smoking ban, smoke and fire detectors
8.1 An absolute smoking ban applies in all indoor areas of the building, in particular in the apartments, corridors, stairwells and the underground car park. It also covers e-cigarettes and vapes, heated tobacco products (e.g. IQOS or glo), herbal cigarettes and shishas. Smoking is only permitted in front of the building and on the terraces.
8.2 In the event of a breach of the smoking ban, MLoft may charge the costs of the necessary special cleaning of the apartment as a flat rate of €250. The guest is entitled to prove that no loss or a significantly lower loss has occurred; MLoft is entitled to prove a higher loss.
8.3 Smoke and fire detectors are installed throughout the building and in all apartments. They must not be damaged, removed, taped over, covered or sealed with materials of any kind.
8.4 If the guest culpably triggers a false alarm, in particular by tampering within the meaning of section 8.3 or by smoking indoors, the guest must reimburse MLoft in full for the resulting costs. This also applies if the false alarm is triggered by guests or other persons for whom the guest is responsible.
8.5 The house rules of MLoft Apartments (Annex 1) form part of these Terms and Conditions (section 1.5) and must be observed by the guest. They contain in particular rules on quiet hours, the smoking ban and fire safety. The fire safety regulations posted on the exit door of the boarding house must also be observed. The house rules can be viewed on the website.
§ 9 Obligations of the guest, use of the apartment
9.1 The apartment may only be used for accommodation purposes. Commercial use that goes beyond living in the apartment is not permitted, for example as a shop, with visits from the public or as a photo studio. Use for events is not permitted either.
9.2 Subletting or re-letting the apartment is not permitted. Nor may the apartment be made available to third parties in whole or in part, whether for payment or free of charge.
9.3 The guests named in the booking are exempt from section 9.2. If a company makes the booking, the exemption applies to the persons whom the company names to MLoft in text form before arrival. Any change of these persons must be notified to MLoft in advance in text form.
9.4 Any further exceptions to sections 9.1 and 9.2 require MLoft’s prior consent in text form.
9.5 The guest must treat the apartment and its furnishings with care. Damage and defects must be reported to MLoft without delay.
9.6 Only small items of laundry may be washed in the apartment.
9.7 The guest must show consideration for other guests and the neighbourhood. Any request by MLoft to stop or reduce undue noise must be complied with. The house rules (Annex 1) form part of these Terms and Conditions and must be observed.
9.8 Dogs may only be brought with MLoft’s prior consent. Other pets are generally not permitted. The surcharge per night is shown in the current information on the website (Services section). The following rules apply:
- The dog must not be left alone in the apartment, not even for a few minutes.
- Only dogs up to a shoulder height of 50 cm are admitted.
- Dogs that are considered fighting dogs under the applicable state regulations or are on a breed list (listed dogs) are not admitted.
- The dog must not behave aggressively in any way towards other guests or MLoft staff.
- The dog must not disturb the quiet hours by barking, howling or whining.
If the guest breaches any of these rules, MLoft is entitled to terminate the contract immediately without notice and to demand immediate departure; section 7.2 applies accordingly. Soiling and damage caused by the dog will be charged to the guest according to the actual, proven expense.
9.9 Electrical and electronic devices brought by the guest must comply with the applicable safety standards and may only be used with due care. Batteries brought along may only be charged and used under supervision. The instructions in the information sheet in the apartment must be observed.
9.10 If a room card is lost, a new card can be issued at the check-in terminal. The lost card becomes invalid immediately.
9.11 To ensure reliable delivery of post, the guest is asked to state the apartment number on their letters. The liability provisions in section 10 apply to the handling of post.
§ 10 Liability of MLoft
10.1 MLoft is liable without limitation for damage resulting from injury to life, body or health and for other damage based on intent or gross negligence on the part of MLoft, its legal representatives or vicarious agents.
10.2 In the case of simple negligence, MLoft is only liable for damage resulting from the breach of material contractual obligations, i.e. obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance the guest may regularly rely. In this case, liability is limited to the foreseeable damage typical of the contract.
10.3 MLoft is liable for items brought in by the guest in accordance with the statutory provisions on the liability of innkeepers (Sections 701 et seq. BGB). A room safe is available in every apartment for storing money and valuables; MLoft recommends using it.
10.4 MLoft carries out wake-up calls, provides information and arranges third-party services with due care. Liability is governed by sections 10.1 and 10.2. If MLoft procures third-party services or facilities for the guest, MLoft acts in the name and on behalf of the guest; the guest is liable for their careful treatment and proper return and indemnifies MLoft against claims by third parties arising from their provision.
10.5 The underground car park is used under a rental agreement, not a custody agreement. Vehicles are not monitored. Liability is governed by sections 10.1 and 10.2.
10.6 If MLoft is prevented from providing its services by force majeure, strikes or comparable circumstances for which MLoft is not responsible, this does not constitute a breach of contract. In this case, MLoft will endeavour to procure equivalent alternative services.
10.7 Items left behind by the guest are kept for six months and forwarded on request against reimbursement of the shipping costs. Liability is governed by sections 10.1 and 10.2.
§ 11 Provision, alternative apartment
11.1 The guest is entitled to an apartment of the booked type, not to a specific apartment.
11.2 If an apartment of the booked type is not available for reasons for which MLoft is not responsible, MLoft may provide the guest with an apartment of at least equal value in the building or at a reasonable distance, provided that this is reasonable for the guest, taking their interests into account. Any additional costs are borne by MLoft; if the alternative apartment is of lower value, the price difference will be refunded.
§ 12 Defects, remedy, price reduction
12.1 If a service is not provided or not provided in accordance with the contract, the guest must notify MLoft without delay so that MLoft can remedy the situation. The guest is obliged to contribute what can reasonably be expected of them to remedy the disruption and to keep any possible damage to a minimum.
12.2 If no remedy is provided within a reasonable period after a request for remedy, the guest may demand a reduction of the price corresponding to the reduced service (price reduction) in accordance with the statutory provisions.
12.3 If the guest culpably fails to report a defect without delay, their claims lapse to the extent that MLoft could have remedied the situation had it been notified in good time.
§ 13 Final provisions
13.1 The law of the Federal Republic of Germany applies. If the guest is a consumer whose habitual residence is abroad, mandatory consumer protection provisions of the state of their habitual residence remain unaffected.
13.2 If the guest is a merchant, a legal entity under public law or a special fund under public law, or has no general place of jurisdiction in Germany, the exclusive place of jurisdiction for all disputes arising from this contract is Munich.
13.3 There is no statutory right of withdrawal for contracts for accommodation services on a specific date or for a specific period (Section 312g (2) No. 9 BGB). The cancellation terms in section 5 apply.
13.4 MLoft is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (Section 36 VSBG).
13.5 Individual agreements take precedence over these Terms and Conditions. For the sake of clarity, amendments and additions to the contract should be recorded in text form.
13.6 Should individual provisions of these Terms and Conditions be invalid, the validity of the remaining provisions remains unaffected. The statutory provisions apply in place of the invalid provision.
13.7 In the event of discrepancies between the German version of these Terms and Conditions and translations, the German version prevails.

Annex 1: House rules of MLoft Apartments Munich
As of October 2026
So that all guests feel at home in the building, the following rules apply. By making your booking, you accept these house rules. They supplement our General Terms and Conditions.
1. Quiet hours and noise
- Quiet hours apply throughout the building from 10 pm to 6 am, including on the terraces and in the underground car park.
- Please keep music, television and conversations at room volume during the day too.
- Loud music is not allowed at any time of day.
- Please close doors quietly, especially in the corridors.
2. No parties or celebrations
- Parties, celebrations and noisy gatherings are not permitted in the apartments, on the terraces or in any common areas.
3. Occupancy
- No more people may stay overnight in the apartment than are confirmed in your booking.
- The permitted number of people depends on the maximum occupancy of the booked apartment.
- A higher occupancy is only possible with MLoft’s prior consent, where applicable for a surcharge.
4. Smoking ban
- An absolute smoking ban applies in all indoor areas: in the apartments, corridors, stairwells, the lift and the underground car park.
- The ban expressly also applies to e-cigarettes and vapes, heated tobacco products (for example IQOS or glo), shishas and herbal cigarettes.
- Smoking is only allowed in front of the building and on the terraces.
- Please dispose of cigarette ends in ashtrays. Do not throw anything over the terrace balustrade.
- When smoking on the terrace, keep the terrace door closed so that no smoke gets into the apartment.
5. Fire safety
Smoke alarms
- Highly sensitive smoke and fire detectors are installed in all apartments, rooms and corridors. They can set off the alarm even with a little smoke, for example from burnt food, steam or cigarette smoke.
- The detectors are not connected to the fire brigade. In an emergency, the fire brigade must always be called by phone on 112.
- Smoke and fire detectors must not be damaged, removed, taped over or covered.
- Please switch on the extractor hood when cooking and baking, and never leave the hob or oven unattended.
Preventing fires
- Open flames are prohibited throughout the building, including candles, incense sticks and tea lights.
- Only operate devices you have brought with you if they meet the latest technical standards, and only while you are present.
- Power banks and batteries may only be charged and used while you are present and under your supervision.
- Report damage to sockets, cables or lamps immediately, as well as signs such as flickering light or a smell of burning. Do not repair anything yourself.
Escape routes and fire doors
- Corridors, stairs and exits must always be kept clear. Please do not leave suitcases, shoes, pushchairs or bicycles there.
- Escape routes are marked with green emergency signs. These signs must not be covered.
- Fire and smoke doors close by themselves. Never prop these doors open with wedges or objects.
- After your arrival, please find out where the escape route runs and where the nearest fire extinguisher is. The fire extinguishers are in the corridor.
- The complete fire safety regulations are posted on the exit door of the boarding house, on the wall to the left.
6. What to do in the event of an alarm or fire
When the alarm sounds
- Take every alarm seriously, even if it could be a false alarm.
- Call the fire brigade immediately: 112. The alarm system does not notify the fire brigade automatically.
- Leave the building calmly by the shortest route via the stairwell. Do not use the lift.
- Inform other guests on your way and help people who need assistance.
- Wait for the fire brigade at a safe place in front of the building.
- Follow the instructions of the fire brigade. Only re-enter the building once the fire brigade has given the all-clear.
If you notice a fire
- Set off the house alarm. The manual call points are at the entrances to the stairwells (blue housing, labelled “Hausalarm”).
- Call the fire brigade on 112 and answer the five questions:
- Who is calling?
- Where is the fire? (MLoft Apartments, Wasserburger Landstr. 8, 81825 München, 1st floor, apartment number)
- What is burning?
- How many people are affected or injured?
- Wait for questions. Do not be the first to hang up.
- You may put out a small fire with the fire extinguisher in the corridor, but only if you do not put yourself at risk. Always keep a way back clear.
- Leave the room immediately if smoke spreads. Smoke gases can be fatal.
Emergency numbers
| Emergency | Number |
|---|---|
| Fire brigade and ambulance | 112 |

If you have dialled 112 by mistake, please do not hang up. Tell the control centre that there is no emergency. Otherwise the emergency services will be sent out unnecessarily.

- When you leave the apartment, please close the windows and the terrace door, switch off the lights in all rooms and switch off the air conditioning.
